    Dear Gabe,

    Thank you for submitting UA Resolution 9 – “2015-2016 Cornell University Campus Code of Conduct Update.”

    While I support the efforts of the University Assembly (UA) to review the Code of Conduct and judicial procedures to ensure that they reflect current needs of the campus community, I am rejecting the resolution for the following reason, related to process.

    The UA is to “improve and sustain the involvement of the campus community in the governance of campus affairs affecting the broad campus community by establishing open, effective, and efficient channels of communication between and amongst the community and university administration.”

    As a deliberative body, it is critical for the UA to consider all sides affected by an issue and to allow ample opportunity for stakeholders to participate in the deliberations. My understanding, based on information I received from Interim Judicial Administrator Jody Kunk-Czaplicki, is that proper inclusion and adequate time for input were not given prior to the UA’s action in this matter, thus hampering the UA’s ability to act as an effective communications channel for its constituencies. For the changes proposed, particularly in section three of UA R9, seeking feedback, input, and expertise from the stakeholders most affected by the changes seems critical.

    If the UA continues to pursue the three distinct and important issues brought forth in this omnibus resolution, I would encourage the UA to consider resubmitting them as separate resolutions so that each proposed change can receive the benefit of full consideration in accordance with the UA process.
