I acknowledge receipt of UA R2: Campus Codes Committee’s Involvement in the Student Code of Conduct Review and Revision Process.
As has been previously discussed in response to other resolutions, when the Student Code of Conduct (SCC) was adopted, the Board of Trustees delegated administration of the SCC to the Vice President for Student and Campus Life (VPSCL), and listed specific roles for different assemblies with regard to the SCC. For example, the VPSCL consults with the Student Assembly and the Graduate and Professional Student Assembly prior to the appointment of a new Director of the Office of Student Conduct and Community Standards, and the University Assembly is tasked with submitting nominations of students, faculty, and staff for the University Hearing and Review Board. All of the assemblies are able to submit proposed revisions to the Code Procedures and Review Committee (CPRC).
Cornell University is responsible for complying with federal law, including compliance with Titles VI, VII and IX of the Civil Rights Act, and must be in a position to effectively adjudicate violations that carry significant potential consequences for the University. The University Assembly does not have delegated authority to administer the Code or to oversee the performance of the Director of the Office of Student Conduct and Community Standards (OSCCS), have its proposed revisions incorporated into the CPRC’s final report, or demand reports or appearances from the Director. The UA can request such reports and attendance, and the administration will provide “to the extent practical and appropriate ... pertinent information” (UA Charter, Section 3.1.2). The UA may make suggestions to the CPRC, but the committee is not required to incorporate those suggestions, and the UA is not entitled to participate on the CPRC.
As I noted in my response to UA R1, the UA is charged with soliciting interest from faculty, staff, and students for participation in the hearing panels, and the availability of trained hearing panelists is an essential component for the hearing panel process to function efficiently. I would appreciate the UA Codes Committee’s engagement with enhancing participation in the panel process.
